Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of October 17, 2006, following the Public Hearing and Public Meeting of
September 26, 2006, the Landmarks Preservation Commission voted to grant a Certificate of Appropriateness for
the proposed work at the subject premises, as put forth in your application completed on August 17, 2006. This
permit will expire on October 17, 2012.

The work, as approved, consists of at the West 23rd Street (north) façade restoring the arch and pilasters at the
former entrance at the first floor; installing three new wood, arch-headed French doors at the first floor; installing
shutters at the first floor window openings; installing a cast iron balconette across the façade at the first floor; and
restorative work at the second through fourth floors; at the roof top, constructing a one-story rooftop addition, set
back from the front and rear façade, but visible from the southwest corner of West 22nd Street and 10th Avenue;
and, at the rear, constructing a non-visible two-story rear yard addition at the basement and first floors; altering
the fenestration pattern by lowering the sills, widening the openings, and installing French Doors at the second
and fourth floors, and widening the windows at the third floor; and installing Juliet balconies at the fourth floor.

for converting the former entry at the first floor on the façade to a window opening; constructing a taller roof top
addition, and installing a glass curtain wall at the rear of the rear yard addition as shown in photo boards, material

In reviewing this application, the Commission noted that the Chelsea Historic District designation report
describes 462 West 23rd Street as an Italianate style rowhouse built in 1857; and that the building's style, scale,
materials, and details are among those features that contribute to the special architectural and historic character of
the Chelsea Historic District. The Commission also noted that Certificate of Appropriatenss 89-0044 (LPC
89-0467) was issued November 3, 1988, for "exterior alterations, including installing a fence and plantings."

With regard to this proposal, the Commission found that that the replication of the missing hoods over the
windows at the first floor and the pilasters adjacent to the historic arched, entry door surround, and the addition of
the shutters and balconette at the first floor will restore historic elements of the façade which have been removed
from the building; that the proposed rooftop addition will be set back from the rear façade, preserving the rear
cornice above the above the fourth floor windows, and maintaining the original volume of the building; that the
proposed rooftop addition will be simple in design and massing and will be in keeping with the form and massing
of the building and typical historic rooftop accretions in the Chelsea Historic District; that the proposed rooftop
addition will not be visible over the front facade and will only be visible over the rear facade in the context of
other secondary facades and against the backdrop of a large brick building across 23rd Street; that the proposed
rear addition will not be visible from any public thoroughfare; that other rear yard incursions exist within the
block, and the height and depth of the proposed addition will be consistent with the existing rear yard additions
on the adjacent buildings and therefore, will not overwhelm this or the adjacent buildings or diminish the central
greenspace; that the rear addition will not extend to the rear lot line or substantially eliminate the presence of the
rear yard; that the rear of the building has no significant architectural features which would be lost or damaged as
a result of the construction of the addition; that the articulation of the rear addition and altered rear façade of the
building, including regular, punched masonry openings filled with casement windows, French doors, and Juliet
balconies is in keeping with the architectural character of rear facades in this historic district; that the altered
window openings will maintain the symmetry of the rear façade, will retain the scale and character of an
individual rowhouse, and will relate to the rear facades of adjacent rowhouses; and that the proposed work will
not diminish the special architectural and historic character of the building or the historic district. Based on these
findings, the Commission determined that the work is appropriate to the building and to the historic district, and
voted to approve this application.

However, in voting to grant this approval, the Commission made its determination subject to the stipulation that
two sets of final signed and sealed drawings, showing the approved work, which are to be filed at the Department
of Buildings, be submitted to the staff of the Commission for review and approval.

Commission has been maintained. Therefore, these drawings are being marked approved by the Commission with
a perforated seal, and this Certificate of Appropriateness is being issued.

This permit is issued contingent upon the Commission's review and approval of the test samples of the finish coat
of the brownstone stucco sample adjacent to clean examples of the original brownstone; and the understanding,
that the work will take place when the exterior temperature remains a constant 45 degrees F or above for a
72-hour period from the commencement of the work. Please contact the Landmarks Preservation Commission
staff when the brownstone samples are ready in order to arrange a site visit.

Also, as the approved work consists of subsurface work, the applicant is required to strictly adhere to the
Department of Buildings TPPN 10/88 governing in-ground construction adjacent to historic buildings. It is the
applicant's obligation at the time of applying for their permit to inform the Department.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
