Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of September 11, 2007 following the Public Hearing of the same date, voted to approve the proposed work at the subject premises, as put forward in your application completed on August 16, 2007. This approval will expire on September 28, 2013. The proposed work, as approved, consists of the removal of the three story addition at 4 East 94th Street, and the extending an existing rooftop addition that spans the two buildings over East 94th Street which features a projecting cornice, multi-paned windows, and stone lintels; the construction of a setback one-story rooftop addition, spanning all three buildings, featuring a mansard slate roof with six six-over-six, double-hung, lead-coated copper dormer windows; alterations at the rear of 4 East 94th Street, including the demolition of an existing full-lot, two-story, rear-yard addition and the construction of a two-story, rear-yard addition, featuring a stucco finish, a lintel spanning four new one-over-one, double-hung windows at the third through sixth floors; four single-paned windows and central glass door at the ground and first floors; the installation of a railing at the first floor; exterior alterations at the rear of 6-8 East 94th Street, including combining two window openings; the installation of multi-paned doors; and the installation of a railing at the fourth floor balcony; exterior work at the ground floor of 6-8 East 94th Street, including the removal of paired doors; the installation of wood paired door and multi-paned transoms set back within the vestibule; the installation of two iron gates beneath the window openings; façade work at 4 East 94th Street, including the installation of decorative lintels, piers and ironwork to match 6-8 East 94th Street; as shown in drawings labeled 1, 1a, 2, 3, 4a, 4b, 5a through 5e, 6, 7a, 7b, 8 through 14, 15a, 15b, 16a, 16b, 17 through 23, and 24a through 24c, dated September 11, 2007, prepared by BKSK Architects, LLP, and submitted as components of the application, and presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that the Expanded Carnegie Hill Historic District designation report describes 4 East 94th Street as a rowhouse originally built in 1890 and converted to a modern style office building in 1963-65, and 6-8 East 94th Street as two rowhouses built in 1890 and combined and redesigned in the neo Classical style in 1936 by George Prentiss Butler, Jr. The Commission also notes that the buildings' style, scale, materials and details are among the features that contribute to the special architectural and historic character of the Expanded Carnegie Hill Historic District; and that 6-8 East 94th Street were included within the boundaries of the original Carnegie Hill Historic District and 4 East 94th Street which was converted to a 7-story office building in 1963-65 was not included in the original district designation. With regard to this proposal, the Commission found that the removal of the upper floors of 4 East 94th Street will eliminate a vertical expansion that detracts from the streetscape; that aligning the height of the streetwall and set back floor of 4 East 94th Street with the historic streetwall and set back on 6-8 East 94th Street will help the building relate better to the adjacent buildings and that the design and details of the proposed façade elements at 4 East 94th Street are based on 6-8 East 94th Street and will help to reunite these three buildings which were originally built as a row and have a history of alterations that have maintained a connection between them; that there is historic precedent for mansard additions on one-story set back floors of townhouses in this historic district, therefore, the presence of the mansard addition on all three buildings will be reminiscent of other buildings of similar style found in this historic district; that the materials and details of the mansard addition will match the types of materials found on historic mansard additions to neo-Classical style buildings; that the removal of the full-lot rear extension on 4 East 94th Street will increase the size of the rear yard and the central greenspace; that because 4 East 94th Street is at the end of the row and adjacent to a large building, the proposed rear wall, which projects beyond the plane of the adjacent houses at 6-8, will not overwhelm these buildings or other buildings of this scale in this block; that the proposed rear façade and fenestration pattern will maintain the scale and character of a rowhouse; and that the alteration to the roof of the bay window on the rear façade of 6-8 East 94th Street to create a balcony will not change the overall appearance of the bay; and that the proposed work will not detract from the special architectural and historic character of the Carnegie Hill Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and to the Historic District, and voted to approve it. However, in voting to grant this approval, the Commission stipulated that the design of the façade of 4 East 94th Street be modified to better distinguish it from 6-8 East 94th Street; and that two copies of the final signed and sealed Department of Buildings filing drawings for the approved work be submitted for review and approval. Subsequently, on October 18, 2007, the Landmarks Preservation Commission received final drawings labeled 1, 1a, 2, 3, 4a, 4b, 5a through 5e, 6, 7a, 7b, 8 through 14, 15a, 15b, 16a, 16b, 17 through 23, and 24a through 24c, dated revised September 17, 2007, and prepared by Harry C. Kendall, Jr., R.A. Accordingly, staff reviewed the drawings and found that the design of 4 East 94th Street has been amended to include the color of the brick as a lighter red color; the design of the ornament above the window lintels at the second floor has been simplified; the design of the window lintels at the third and fourth floors have been simplified; and the dormers at the roof have been changed from arch-headed to an angled pediment; as shown in drawing labeled A9, dated October 22, 2007, prepared by Harry C. Kendall, Jr., R.A. The Commission reviewed the drawings and written specifications and found that the design maintains differentiation between these two buildings within the historic district and that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved with a perforated seal and Certificate of Appropriateness 08-4616 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of PAGE 2 Issued: 12/17/07 DOCKET: 07-5906 approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
