Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of May 15, 2007, following the Public Hearing and Public Meeting of March 20, 2007, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on February 22, 2007, as you were informed in a Status Updated Letter dated May 29, 2007. The work, as approved, consists of the construction of a new two-story house on the south-west corner of the site, with stone cladding, multi-light windows painted off-white, dormer windows set in the pitched roof which will be clad in dark gray asphalt shingles, and the main entrance and the doors to a two-car attached garage at the north-east corner of the house all facing Iron Mine Drive, as shown in drawings LPC 1 through LPC 17, all dated May 15, 2007, which include a plan locating buildings in this area of Staten Island designed by Ernest Flagg, copies of original sketches of Wallcott; a site plan, photographs of the site and of other nearby houses designed by Flagg, floor plans, elevations, site sections, detail drawings, and photographs of a model, all prepared by Kaitsen Woo Architect, P. C. and presented at the Public Hearings and the Public Meetings. As originally presented, on March 20 in drawings LPC 1A, 1B, 2, 3, 4, 5A, 5B, and 6 through 15, all dated March 20, 2007, the proposed house was 4' - 2" wider. In reviewing this proposal, the Commission noted that the Designation Report describes 285 Flagg Place as a stone clad cottage designed by Ernest Flagg and built in 1918-21. The Commission also noted that the historic buildings at 285 Flagg Place occupy a large sloping triangular corner lot with mature trees; that the main house and garage were built as two structures, but were joined prior to designation; and that the lot was sub-divided into three building lots pursuant to Certificate of No Effect 99-5845, issued on May 3, 1999, allowed subdivision of the original site into three building lots, without approving the construction of any additional building, resulting in the historic house sitting on 2/3 of the original lot; and that the proposed building will sit on one of the lots created by sub-dividing the site. With regard to this proposal, the Commission found that the form and massing of the house, in terms of its overall height, floor-to-floor height, prominent roof, dormers, and roof lights, is harmonious with the predominant massing of houses designed and built by Flagg; that the predominant material proposed for the facade, stone cladding, relates sensitively to the stone cladding used on the smaller buildings designed by Flagg, and the stone perimeter walls, the foundation walls, and the cladding on the north wing at Stone Court; that the overall fenestration, in terms of the predominant use of 8-over-1 double-hung wood windows organized in a regular bay pattern is similar to the window patterns used by Flagg, helping the building to relate harmoniously to the adjacent house; that the orientation of the house, facing north towards Iron Mine Drive, helps to minimize its impact upon Wallcott, which faces south onto Flagg Place; that the houses will only be seen in conjunction with each other from a small section of Flagg Place; that where they are seen in conjunction with each other, the portions of the houses which are closest to each other are the informally massed rear facades, minimizing the impact of the new building on the street facade of the Flagg house; that because the rear wing of the historic house was originally constructed as a free-standing garage building adjacent to the main house, joined together prior to designation, there is a precedent for more than one free-standing building on this full site; that the increased distance between the proposed house and Wallcott, and the reduction of the mass of the proposed house, allows each to be seen independently and minimizes the impact upon Wallcott; and that for these reasons the construction of the new building is in keeping with the historic building and site. Based on these findings, the Commission determined the proposed work to be appropriate to the building, and voted to approve it. However, in voting to grant this approval, the Commission made its determination subject to the following condition; 1. that two sets of signed and sealed Department of Building construction drawings be submitted to the Commission for review. On November 20, 2007, the staff of the Commission received the requested filing drawings, including drawing 1, dated August 31, 2007, and drawings 2 through 6, all dated September 13, 2007, and catalog cuts for the proposed roof shingles, artificial stone, windows, front door, and garage doors, all prepared by Charles A. Magrino, R. A. Staff has reviewed these materials and finds that the proposal approved by the Commissioners has been maintained in the filing drawings. Based on this and the above findings, these drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 08-5991 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to John Graham.
