Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of October 23, 2007, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on September 27, 2007. This permit will expire on October 23, 2013. The work, as approved, consists of removing the existing non-historic storefront infill and installing aluminum storefront infill and a dark purple awning. This work was shown in photo boards and boards 1 and 2, dated October 23, 2007, prepared by Loffredo Brooks Architects, P.C., and submitted as components of the application, and presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that the Ladies' Mile Historic District Designation report describes 3 East 17th Street as a store and loft building designed by Frederick C. Zobel, and built in 1903-04, and altered in 1941; and that the building's style, scale, materials, and details are among the features which contribute to the special architectural and historic character of the Ladies' Mile Historic District. With regard to this proposal, the Commission found that that the proposed work will not involve the removal of significant original or historic building fabric; that the proposed storefront infill will fit neatly within the openings framed by the original masonry piers strengthening the base of the building; that the configuration of the proposed storefront, featuring a paneled bulkhead, large display window and recessed entry doors with transom, is in keeping with the configuration of historic storefronts found elsewhere within the Ladies' Mile Historic District; that the metal bulkhead with a decorative panel recalls the design and character of metal bulkheads with grilles found elsewhere within the Ladies' Mile Historic District; that proposed finish of the storefront framing will recall the painted finishes found on historic storefronts in this historic district; that the shape, size and slope of the proposed fixed purple canvas awning with a flexible skirt is in keeping with the types of awnings historically used on buildings of this age and style; and that the proposed work is in keeping with the special architectural and historic character of the Ladies' Mile historic district. Based on these findings, the Commission determined the proposed work to be appropriate to the building and to the Ladies' Mile Historic District, and voted to approve it. However, in voting to grant this approval, the Commission made its determination subject to the stipulation that the proposed finish color of the storefront infill be lightened; and that two sets of final signed and sealed drawings, showing the approved work, which are to be filed at the Department of Buildings, be submitted to the staff of the Commission for review and approval. Subsequently, on November 19, 2007, the staff of the Commission received a finish sample and drawing A-1, dated August 20, 2007, prepared by Frank S. Loffredo, R.A. The Commission reviewed the submitted drawings and found that the change requested by the Commissioners has been incorporated into the proposal; and that the proposal approved by the Commission has been maintained. Therefore, these drawings are being marked approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
