| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of October 16, 2007, following the Public Meeting of August 14, 2007, and the Public Hearing of August 7, 2007, voted to grant a Certificate of Appropriateness for work at the subject premises, as put forward in your application completed on July 12, 2007. The proposal, as approved, includes removing the existing rear elevation and one-story pool enclosure; and constructing a new modern painted brick, and grey and white stucco rear elevation featuring large single pane windows; constructing a glazed pool enclosure; and the installing an approximately nine foot high wood fence at the rear yard. The proposal was shown on presentation boards consisting of a site plan, historic photographs, current condition photographs, drawings LM 0.0, LM 1.0, LM 2.0, LM 2.1, LM 2.2, LM 2.3, LM 2.4, LM 3.0, LM 3.1, LM 3.2, LM 3.3, and LM 3.4, dated October 1, 2007; and drawings LM 0.0, LM 1.0, LM 1.1, LM 1.2, LM 1.3, LM 1.4, LM 1.5, LM 1.6, LM 1.7, LM 1.8, and LM 1.9, dated August 7, 2007; all prepared by Resolution: 4 Architecture; and all presented at the Public Meetings. In reviewing this proposal, the Commission noted that the designation report describes 12 East 82nd Street as a rowhouse built in 1888-89 by Edward Kilpatrick, and altered in the neo-Federal and neo-Georgian style in 1920 by Bradley Delehanty; and that the building's style, scale, materials and details are among the features that contribute to the special architectural and historic character of the Metropolitan Museum Historic District. With regard to this proposal, the Commission found that the existing rear elevation is already heavily altered, and therefore does not retain its original character; that the alterations will not be visible from any public thoroughfare; that the addition will not project any farther into the central greenspace than the existing, and will not compromise the historic character of the center of the block; and that because the building's relationship to the row of which it is a part has been compromised by the enlargement of the house in 1920, the change in plane of the historic rear wall will not alter its historic relationship to its row. Based on these findings the Commission determined the work to be appropriate to the building, the streetscape, and the Metropolitan Museum Historic District, and voted to approve this application. However, the Commission made its determination subject to the stipulation that two sets of Department of Buildings filing drawings be submitted to the Commission for review and approval. Subsequently, on October 26, 2007, the Commission received drawings A0.0, A1.0, A1.1, A1.2, A1.3, A2.0, A2.1, A2.2, A2.3, A3.0, A3.1, and A3.2, dated October 1, 2007, prepared by Robert I. Luntz, R.A. The Commission reviewed the drawings and found that the work approved by the Commission has been maintained. Based on this and the above findings, the drawings are being marked approved with a perforated seal, and Certificate of Appropriateness 08-4848 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
