Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of August 7, 2007, following the Public Hearing of July 24, 2007, voted to
grant a Certificate of Appropriateness for work at the subject premises, as put forward in your application
completed on June 21, 2007.

The proposal, as approved, includes the demolition of a bulkhead, and the construction of two new bulkheads on
the roof of the number 25 building. The proposal was shown on presentation boards consisting of a historic
district map, current condition photographs, mock-up photographs, and drawings LPC-1, LPC-2, LPC-3,
LPC-3A, LPC-3B, LPC-4, LPC-5, LPC-6, LPC-7, and LPC-8, dated June 10, 2007, prepared by Marren and
Newman Architects; and all presented at the Public Meeting.

In reviewing this proposal, the Commission noted that the Soho-Cast Iron Historic District Designation describes
25 Mercer Street as a neo-Grec style store and factory building, with neo-Classical elements, built in 1861; and
27 Mercer Street as a store building built in 1867; and that the buildings' style, scale, materials and details are
among the features that contribute to the special architectural and historic character of the Soho-Cast Iron Historic
District. The Commission further noted that there is an existing bulkhead at the roof which is visible over the
undeveloped secondary north elevation.

With regard to this proposal, the Commission found that the removal of the existing bulkhead will not result in
the elimination of a significant architectural or historic feature; that the proposed larger bulkheads will be only
visible over the undeveloped secondary façade, and therefore will not detract from the street elevation; that the
stucco clad additions will resemble other utilitarian rooftop features that are typically found within this district
and buildings of this age and type; that the proposed rectangular shape of the proposed additions will present a
silhouette which is typical of rooftop bulkheads traditionally found on tall buildings within the district; and that
the additional bulk at the rooftop will not detract from the surrounding area given the large scale of the loft
building in relation to its urban landscape. Based on these findings the Commission determined the work to be
appropriate to the building and historic district, and voted to approve this application.

However, the Commission made its determination subject to the stipulation that two sets of Department of
Buildings filing drawings be submitted to the Commission for review and approval. Subsequently, on September
14, 2007, the Commission received drawings A-001, A-002, A-010, A-011, A-012, A-100, A-101, A-102, A-103,
A-104, A-105, A-106, A-300, A-301, A-302, A-303, A-304, A-305, A-310, A-320, A-321, A-401, A-402, A-410,
A-420, and A-421, dated received September 14, 2007, prepared by Peter Michael Marren, R.A. The
Commission reviewed the drawings and found that the work approved by the Commission has been maintained.
Based on this and the above findings, the drawing is being marked approved with a perforated seal, and
Certificate of Appropriateness 08-3048 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
