Text Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of September 18, 2007, following the Public Hearing of July 10th, 2007,
voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your
application completed June 14, 2007.

The proposal, as approved, consists of the removal of the existing modern storefront infill, the restoration of two
historic cast iron columns flanking the storefront, and the installation of new symmetrical painted wood and glass
storefront infill, featuring painted paneled wood bulkheads, a tri-partite transom, and security gates and housing
set inside the glass; the construction of a rooftop addition, set behind the parapet; the construction of a two-story
rear yard addition, set on the roof of the second floor; and related interior alterations. The proposal, as initially
presented, included the installation of non-symmetrical storefront infill, and construction of the rooftop addition
above the existing roof beams. The proposal was shown in drawings 1, 2, 2a, 3 through 9, 10a, 10b, and 11, all
dated July 10, 2007, drawings 3, 4, 5, 5a, 6, 7, 10a, and 10c, and a photo-montage, all dated September 18, 2007,
a block plan, historic photographs, and photographs of the existing conditions, all prepared and presented at the
Public Hearing and Public Meetings by SPG Architects.

In reviewing this proposal, the Commission noted that the designation report describes 863 Broadway as an
Italianate style building built in 1842, and altered in 1885 to include a ground floor storefront; and that its style,
scale, materials, and details are among the features which contribute to the special architectural and historic
character of Ladies Mile Historic District.



The Commission also noted that the cellar, first, and second floors were all extended to the rear lot line prior to
designation; that the rear facade is not visible from any public way; that the ground floor storefront was altered
prior to designation; that Landmarks Preservation Commission Permit for Minor Work 02-2813 was issued on
December 7, 2001, for alterations to the non-visible rear facade; that Permit for Minor Work 05-0857 was issued
on July 29, 2004, for restoration of the front facade; that Certificate of No Effect 06-3554 was issued on
November 4, 2005, for repairs to the southern-most demising wall, where the building abuts 861 Broadway; that
the building and its neighbor to the south suffered a collapse, resulting in the loss of the rear wall and roof, and
also substantial portions of the south demising wall and front façade; that Certifiacte of No Effect 07-4373 was
issued on December 13, 2006, for reconstruction of the southern-most demising wall and the installation of steel
structural members; and that Miscellaneous/Amendment 07-6942 was issued on March 20, 2007, amending
Certificate of No Effect 07-4373, and adding additional structural bracing.


With regard to this proposal, the Commission found that because the rear façade and roof have collapsed and are
currently being reconstructed, the additional construction at the roof and rear facade will not eliminate any
significant historic fabric; that the rooftop and rear additions are modestly sized, and will not substantially
increase the volume of the building, thereby maintaining the residential scale of the building within this
commercial block; that the building is surrounded by larger commercial buildings, and the existing building and
the adjacent smaller buildings to the south have full lot rear extensions which date to the commercial conversion
of these buildings, therefore, the proposed additions will not overwhelm or detract from the character of the
adjacent buildings; that the proposed rooftop addition will be lower than the height of the existing adjacent
building and will only be visible against a backdrop of the taller building to the north, and in conjunction with the
surrounding rooftop additions; that the simple design and utilitarian tan stucco cladding will help the addition
blend in with adjacent buildings, and will not call undue attention to the addition; that this setback rooftop
addition will only be minimally visible at an oblique angle from a distance at Union Square and will not detract
from the significant features of the building; that restoring the historic cast iron columns at the ground floor will
preserve these significant features; that the proposed storefront, featuring a painted finish, paneled wood
bulkheads, symmetrical doors and transoms will recall traditional storefronts found in this historic district; and
that the proposed work will not diminish the special architectural and historic character of the building, the
streetscape, or the Ladies Mile Historic District. Based on these findings, the Commission determined the
proposed work to be appropriate to the building, and voted to approve it.


On September 21, 2007, the Commission received drawings F0.1, F0.2, F1.1 through F1.4, F2, F3, F6.1, and
F6.2, all dated September 20, 2007, all prepared and submitted by SPG Architects. Staff has reviewed these
materials and finds that the proposal approved by the Commission has been maintained. Based on this and the
approved findings, Certificate of Appropriateness 08-3532 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
