Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of October 23, 2007, following the Public Hearing of the same date voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your application completed on September 27, 2007. The proposal is for the construction of a greenhouse at the roof, featuring a glass and aluminum framed enclosure on steel dunnage with a stucco knee wall; and the installation of a railing on the interior of the parapet wall. The proposal was shown in photographs, photo-montages and drawings labeled L1.0, L3.4, L1.0A, L1.2, L2.0, L3.3, L3.5 through L3.7, dated revised October 23, 2007, prepared by David Piscuskas, R.A., which were submitted as components of the application and presented at the Public Hearing and Meeting. In reviewing this proposal, the Commission notes that the Greenwich Village Historic District designation report describes 11-13 West 10th Street as a Greek Revival style rowhouse built in 1847 and altered in 1888 by Ernest Flagg, with additional alterations in 1919; and that the building's style, scale, materials, and details of the building are among the features that contribute to the special architectural and historic character of the Greenwich Village Historic District. The Commission found that the proposed rooftop addition will not cause damage to any significant features of the building; that the rooftop greenhouse will only be visible at a distance from a single vantage point on Fifth Avenue, in the context of other rear elevations; that the addition will be small in scale, and simple in design, and will therefore not call undue attention to itself; and that the work will not detract from the special architectural and historic character of the building or the Greenwich Village Historic District. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the historic district and voted to approve it. However, the Commission made its determination subject to the stipulation that two sets of final signed and sealed drawings, which shall be filed at the Department of Buildings, be submitted for review by the staff of the Commission. Subsequently, the staff of the Commission received drawings labeled A0.0, A2.0, A2.1, and A5.0, dated revised October 22, 2007, prepared by David Piscuskas, R.A. Accordingly, staff reviewed these materials and determined the approved design has been maintained. Based on this and the above findings, the drawings have been marked approved by the Commission with a perforated seal and Certificate of Appropriateness 08-4420 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
