| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of September 18, 2007, following the Public Hearing of September 11, 2007, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your application completed August 16, 2007, and as you were informed in Status Update Letter 08-3262 (LPC 08-1441), issued September 20, 2007. The proposed work, as approved, consists of removing the exterior security roll-down gates and awning; replacing the existing metal and glass shopfront with a new black-painted, wood and glass shopfront, featuring a recessed entrance, display windows, a bulkhead, and sign panel. The proposed shopfront also includes a horizontal flush mounted louver at the top of the shopfront and 1" projecting illuminated lettering ("sunglass hut") and a logo at the sign panel. The work was shown on five presentation boards, labeled L1 through L5 by the Commission staff, dated July 2007, and consisting of drawings and photographs, all prepared by Michael Schuster Associates (MSA), and presented at the Public Hearing and Public Meeting. In reviewing this proposal, the Commission noted that the Greenwich Village Historic District Designation Report described 351-353 Bleecker Street (aka 213-215 West 10th Street) as an apartment house built in 1903; and that the building's style, scale, materials and details are among the features that contribute to the special architectural and historic character of the Greenwich Village Historic District. The Commission also noted that Notice of Violation 85-0557 was issued April 16, 1985 for "the ongoing installation of aluminum and glass shopfront and security roll-gates and housing without permits;" Notice of Violation 88-0249 was issued October 20, 1987 for "the ongoing interior and shopfront alterations without permits;" Notice of Violation 88-0698 was issued May 31, 1988 for "the ongoing facade work (including repointing) without permits;" Warning Letter 05-0640 was issued June 27, 2005 for the "installation of awning ("Charley and Kalley") without permit(s)" and advanced to a Notice of Violation on August 16, 2005; and Commission Denial 08-0627 (LPC 07-7645) was issued July 12, 2007, denying a proposal to modify the shopfront. The Commission finally noted that Warning Letters 08-0134 through 08-0153 were issued September 10, 2007 for "exterior ironwork painted green in non-compliance with Permit for Minor Work No. 439 (LPC 73-130) issued February 7, 1974;" "sign ("Apartments for Lease") installed on West 10th Street facade without permit(s);" "security roll gate installed at commercial space ("Charley and Kelley") at 353 Bleecker Street without permit(s);" "neon sign ("Charley and Kelley") in shop window at 353 Bleecker Street installed without permit(s);" "entry door at commercial space ("Charley and Kelly") at 353 Bleecker Street in non-compliance with Permit for Minor Work No. 439 (LPC 73-130 issued February 7, 1974;" "fixed awning installed at 213 West 10th Street commercial space (currently "IInna Sense") without permit(s);" "commercial entrance door at 213 West 10th Street (currently "Inna Sense") in non-compliance with Permit for Minor Work No. 439 (LPC 73-130) issued February 7, 1974;" "alterations to storefront at corner of Bleecker and West 10th Street (currently "Nustraty Afghan Imports") without permit(s);" "alterations to storefront at 351 Bleecker Street, (currently "Condomania") without permit(s);" "installation of awning at 351 Bleecker Street storefront, (currently "Condomania") in non-compliance with Permit for Minor Work 1547 (LPC 77-272) issued June 21, 1977;" "installation of security roll gate at 351 Bleecker Street, (currently "Condomania") without permit(s);" "installation of security roll gate at 357 Bleecker Street storefront, (currently "Jewelry Repair") without permit(s);" "installation of commercial awning at 353 Bleecker Street, (currently "Verve") without permit(s);" "installation of security gates at storefront at 353 Bleecker Street, (currently "Verve") without permit(s);" "alteration of storefront at 353 Bleecker, (currently "Verve") without permit(s) and in non-compliance with Permit for Minor Work 439 (LPC 73-130) issued February 7, 1974;" "installation of awning at 353 Bleecker Street store, (currently "Gerry's) without permit(s);" "installation of security roll gate at 353 Bleecker Street storefront, (currently "Gerry's") without permit(s);" "alterations to storefront at 353 Bleecker Street, (currently "Gerry's) without permit(s);" "installation of security roll gate at 353 Bleecker Street storefront, (currently "Arlene Bowman Antiques") without permit(s);" and the "replacement of commercial space entry door at 353 Bleecker Street storefront, (currently Arlene Bowman Antiques") in non-compliance with Permit for Minor Work 439 (LPC 73-130) issued November 27, 1973" respectively; and that Warning Letter 08-0201 was issued September 28, 2007 for the "replacement of windows without permit(s)." With regard to this proposal, the Commission found that the replacement of the previous shopfront without a permit from the Commission has not eliminated an original shopfront or a significant later alteration; that the removal of the awning and exterior security roll-down gates and housing will eliminate elements that clutter the base of the building; that the design of the proposed shopfront, including display windows, a bulkhead, entrance, transom and sign band, is in keeping with the organization of historic shopfronts at buildings of this type, style and age; that proposed black painted finish of the infill and installation of moldings will be in keeping with historic finishes and detailing at historic shopfronts throughout the historic district; that the proposed scale and placement of signage within the sign band above the shopfront will be well related to the shopfront design and harmonious with the overall proportions and organization of the building; that the louver will be well integrated into the design of the shopfront; that the limited amount of illuminated signage consisting of projecting cut-out translucent letterings, within a flush-mounted sign, at this modern shopfront will not detract from historic features of the building or overwhelm the streetscape; and that this work will not diminish the special architectural and historic character of the building or the Greenwich Village Historic District. Based on these findings, the Commission determined the work to be appropriate to the building and the historic district and voted to approve the application. The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of two sets of signed and sealed Department of Building filing drawings showing the approved design. Subsequently, on September 26, 2007 and October 23, 2007, the Commission received final drawings A-0.1, A-0.2, A-0.3, A-1.0, A-1.1, A-1.2, A-1.3, A-2.0, A-2.1, A-3.0, and A-4.0, dated revised September 21, 2007 and prepared by Michael N. Schuster, RA; final drawings M-1.0, M-1.1, E-1.0, E-1.1, and E-2.0, dated revised September 21, 2007 and prepared by Robert Anthony Lonnemann, PE. Accordingly, staff reviewed these materials and noted that they include additional work, consisting of interior alterations at the first floor shopfront, including the demolition and construction of non-bearing partitions and finishes and plumbing, electrical, mechanical and HVAC work. Based on these and the above findings, the drawings have been marked approved with a perforated seal and Certificate of Appropriateness 08-4035 is being issued. PLEASE NOTE: Notices of Violation 85-0557, 88-0698, and 05-0640 and Warning Letters 08-0134, 08-0135, 08-0136, 08-0137, 08-0138, 08-0139, 08-0140, 08-0141, 08-0145, 08-0146, 08-0147, 08-0148, 08-0149, 08-0150, 08-0151, 08-0152, 08-0153 and 08-0201 remain in force and are not addressed by this permit; Notice of Violation 88-0249 is only partially addressed by this permit and will remain in force until all aspects of the Notice are addressed; and Warning Letters 08-0142, 08-0143, 08-0144 will remain in effect until the work approved under this permit has been completed and inspected for compliance. NOTE THAT THIS PERMIT CONTAINS A COMPLIANCE DATE OF MAY 23, 2008. Failure to complete the work by this date may result in the issuance of Notices of Violation (NOV) originating from the Environmental Control Board in accordance with Title 63 of the Rules of the City of New York, Section 7-02 (c). Once the corrective work is completed, promptly submit a written request for a Notice of Compliance from the building owner, along with a photograph documenting the finished work, to the Commission. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
