| Text | ISSUED TO: John Mehas 481 West 22nd Street New York, NY 10011 Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of September 18, 2007, following the Public Hearing and Public Meeting of August 14, 2007, voted to approve a proposal to construct a rooftop and a rear yard addition as put forward in your application completed July 19, 2007. The approval will expire September 18, 2013. The work, as approved, consists of the construction of a one-story stucco-clad rooftop addition, with large glass windows and glass french doors at the north and south elevations, which open out onto new terrace spaces with simple iron railings; the construction of a non-visible two-story rear-yard addition, featuring one large masonry opening with multi-pane steel and glass windows, and a terrace with decorative ironwork which will be accessed from the third floor; and alterations at the rear facade, including the removal of six (6) one-over one double hung windows at the second, third and fourth floors, the lengthening of the masonry openings, and the installation of new wood and glass french doors, with the four openings on the third and fourth floors also receiving new decorative metal balconettes. The proposal, as initially presented to the Commission, included a penthouse with greater visibility over the front façade. The work was shown on presentation boards consisting of photomontages, and drawings labeled 1 through 5, dated revised September 18, 2007; and drawings 01 through 19, dated 8/14/2007; all prepared by Edward I. Mills & Associates and presented at the Public Hearing and Public Meetings. In reviewing this proposal, the Commission notes that Chelsea Historic District designation report describes 481 West 22nd Street is an Anglo-Italianate style house built in 1856; and that the building's style, scale, materials, and details contribute to the special architectural and historic character of the Chelsea Historic District. With regard to this proposal, the Commission found that there are other existing rooftop additions at adjacent roofs; that as seen from 10th Avenue, mid-block between 22nd Street and 23rd Street, over a mid-block gap in the streetwall, the proposed rooftop addition will have a modest profile that will not call undue attention to itself when seen against the smooth roofline of adjacent rowhouses; that the proposed rooftop addition will be only minimally visible over the front facade from the park at the corner of 22nd Street and 10th Avenue; that the simple shape and the neutral color of the materials selected for the addition will allow it to blend in with the surrounding roofscape; that the proposed rear yard addition will not be visible from any public thoroughfare; that the rear yard addition will not overwhelm the building, and will allow the building to retain the scale of an individual rowhouse; and that the rear yard addition will not project into the rear yard further than other rear yard addition at adjacent buildings and other building's within the block, and therefore will not diminish the central greenspace; and that the new doors and balconettes at the rear facade will only be minimally visible from a public throughfare, and will not call undue attention to themselves. Based on these findings, the Commission determined the proposed work to be appropriate to the building and the Chelsea Historic District, and voted to approve it. The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of two sets of signed and sealed Department of Building filing drawings showing the approved design. Subsequently, on October 12, 2007, the Landmarks Preservation Commission received final drawings A-0.01 (dated 9/28/07); A-0.02, D-1, D-2, and A-1 through 8-11, dated 10/11/07, all prepared by Edward Mills, R.A.; S-001, S101, S102, S103, S-501, dated 10/11/07, and prepared by Nizar Khoury, P.E.; and H-101.1, H-101.2, H-102.1, H-102.2, H-201, H-205, P-101, P-102, P-201, P-202, P-203, SP-101, SP-102, and SP-201, dated 5/30/07, and prepared by Stanislav Slutsky, P.E. Accordingly, staff reviewed the drawings and found that the proposal included additional work, including reconfiguration of three (3) HVAC units at the roof of the rooftop addition, in order to eliminate visibility from a public thoroughfare. With regard to this work, the Commission finds, in accordance with the R.C.N.Y. Title 63, Section 2-19 (e) (1), that installation of the new rooftop HVAC units will not be visible from any public thoroughfare; and that the installation of the new units will not result in damage to, or demolition of, any significant architectural features of the building. Additionally, staff also finds that the design approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 08-4217 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
