Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of September 25, 2007, following the Public Hearing of the same date, voted
to approve certain work at the subject premises, as put forward in your application completed on August 30,
2007. This approval will expire on September 25, 2013.

The proposed work, as approved, consists of removing the existing double-hung multilight windows and panning
and installing new arch-headed double-hung aluminum windows with new wood brick molds, all painted black at
the 15th floor, as shown in A.0.00, A.0.01, A.0.02, A.0.03, A1.01, A.1.02, A.1.03, A.1.04, A.1.05, dated January
8, 2007, all prepared by Shawn Charles Basler R.A., submitted as components of the application and presented at
the Public Hearing and Public Meeting.

In reviewing the proposal, the Commission notes that the Upper West Side-Central Park West Historic District
Designation describes 341 Amsterdam Avenue as a neo-Renaissance style apartment building designed by Emery
Roth and built in 1925; and that in terms of its style, scale, materials and details, the building contributes to the
special architectural and historic character for which the Upper West Side-Central Park West Historic District
was designated. The Commission further notes that Notice of Violation 03-0144 was issued August 8, 2002 for
"installation of northern-most Amsterdam Avenue shopfront, signage ("River"), flagpoles with stretch banners
and lighting without permits"; Notice of Violation 03-0817 was issued March 27, 2003 for "alterations to 3rd
southernmost Amsterdam Avenue ground floor bay (M Salon), including removal of entrance, without permit(s)";
Notice of Violation 03-0818 was issued March 27, 2003 for "installation of retractable awnings ("M Salon") at
corner shopfront without permit(s)"; and Notice of Violation 03-0819 was issued March 27, 2003 for
"replacement of windows throughout Amsterdam Avenue and West 76th Street facades without permit(s)".

The Commission finally notes that corrective work for three of the four outstanding violations is currently
underway, and that the work proposed under this permit will address the fourth outstanding violation.

With regards to this proposal, the Commission found that the new arched headed multi-light double-hung
aluminum window sashes will recall the arched headed multi-light configuration, double-hung operation, and
dark finish of the historic window sashes; that the dimensions and details of the proposed aluminum sashes will
closely match those on the historic window sashes; that removing the aluminum panning over the window frames
and installing new wooden brick molds in its place to match the historic brick mold will restore a significant
feature of the building; that the because of the dark factory applied finish, the location at the fifteenth floor, and
the use of new wood brickmolds that will match the historic brickmold, the change in sash material will not be
perceptible from the street; and that the new aluminum window sashes will match the existing aluminum window
sashes throughout the building facades along Amsterdam Avenue and West 76th Street, and will bring material
consistency in the fenestration of these facades. Based on these findings, the Commission determined the
proposed work to be appropriate to the building and the Upper West Side-Central Park West Historic District and
voted to approve it.

The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of
two signed and sealed sets of the Department of Buildings drawings for the approved work.

Subsequently, on September 26, 2007, the Landmarks Preservation Commission received final drawings labeled
A.0.00, A.0.01, A.0.02, A.0.03, A1.01, A.1.02, A.1.03, A.1.04, A.1.05, dated January 8, 2007, all prepared by
Shawn Charles Basler R.A. The Commission reviewed the drawings and found that the proposal approved by the
Commission has been maintained. Based on this and the above findings, the drawings have been marked
approved with a perforated seal and Certificate of Appropriateness 08-3619 is being issued.

Please note that this permit contains a compliance date of March 25, 2008. Failure to address this violation will
result in the issuance of a second Notice of Violation originating from the Environmental Control Board in
accordance with Title 63 of the Rules of the City of New York, Section 7-02(c). This NOV would require a court
appearance and a civil penalty may be imposed and cannot be cured.

Please note that Notice of Violation 03-0819 remains in force against the property until the approved work is
completed in compliance with this permit, and photographs of the completed work are submitted to the
Landmarks Preservation Commission along with a written request for a Notice of Compliance.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
