Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of January 16, 2007, following the Public Hearing and Public Meeting of October 31, 2006, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises as put forward in your application completed on September 28, 2006, and as you were notified in Status Update Letter 07-5068 (LPC 07-1892) dated January 16, 2007. This approval will expire on January 16, 2013. The proposal as approved consists of removing the existing entrance doors, glazing and framing of the main entrance and installing new infill consisting of single-light doors, sidelights, single pane display window with clear-finished, brushed steel framing; removing the paint from the bricks at the side wall and remounting the name and address of the building as shown in existing-condition photographs, material samples and drawings A101, A102 and A901 dated January 2, 2007, prepared by Norman R. Cox, architect, submitted as components of the application and presented at the Public Hearing and Public Meetings. As originally presented, the proposal included redesigning the original entrance canopy, eliminating the recessed entrance and a planter; and installing new entrance infill aligned with the plane of the facade. In reviewing this proposal, the Commission noted that 45 West 10th Street, known as the Peter Warren Apartments, is a ten-story modern style brick apartment building, constructed in 1959; and that in terms of the building's style, scale, materials, and details, the building contributes to the special architectural and historic character of the Greenwich Village Historic District. The Commission also noted that Certificate of No Effect 99-1416(LPC 99-1090) was issued September 8, 1998, for removing the existing metal and glass lobby doors, transom, windows, and air conditioning unit; constructing a flagstone bulkhead next to the entry door to match the height of the adjacent flagstone planter; installing new metal and glass lobby doors and windows with a brushed bronze finish; installing a flush-mounted air-conditioning unit at the new bulkhead with a brushed bronze finished metal grille; and that Certificate of Appropriateness 94-0145(LPC 94-1309) was issued on April 1, 1994, for replacing the glass tile veneer at the ground floor with a granite veneer. With regard to this proposal, the Commission found that the proposed modifications to the main entrance will maintain the original angled footprint of the entrance, a character defining feature of the building; that the proposed modifications will maintain the integrity of the building's design and retain significant features in the streetscape; that the new entrance infill, consisting of single light doors, sidelights, steel window with brushed steel framing with a clear finish, and new bricks on the side wall are in keeping with the materials and details of the building; and that the cumulative effect of the changes will not diminish the special architectural character of the building. Based on these findings, the Commission determined the work to be appropriate to the building and to the historic district and voted to approve it. However, the Commission made its determination with the stipulation that two sets of final Department of Buildings' filing drawings be submitted to the Commission for review and approval. Subsequently, the Commission received drawings A101, A102 and A901 dated January 2, 2007, prepared by Norman R. Cox, architect. Accordingly, the staff reviewed the drawings and found that the proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved with a perforated seal and Certificate of Appropriateness 07-5427 is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to James Dillon. Robert B.
