| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of August 1, 2006, following the Public Hearing of the same date, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on July 6, 2006. This permit will expire on August 1, 2012. The work, as approved, consists of removing the existing modern infill, lighting, awnings and signage installed without Landmarks Preservation Commission permits on the Seventh Avenue façade; and installing wood and glass storefront infill, painted dark green; and installing canvas awnings at each storefront opening; as shown in presentation boards LPC1 through LPC9, dated July 24, 2006, prepared by Loren Cannon, R.A., submitted as components of the application, and presented at the Public Hearing and Public Meeting. In reviewing the application, the Commission noted that the Greenwich Village Historic District designation report describes 33 Barrow Street, also known as 73 7th Avenue South, as a two-story building designed by Samuel H. Brooks and built in 1927; and that the style, scale, materials, design and detail of the building are among the features which cause it to contribute to the special architectural and historic character of the Greenwich Village Historic District. The Commission finally noted that Notice of Violation 88-0536 was issued on March 23, 1988, for "installation of awning and shopfront and painting of facade"; Notice of Violation 90-0554 was issued on May 28, 1990, for "ongoing removal of shopfront"; Notice of Violation 91-0658 was issued on May 7, 1991, for "removal of shopfront"; Warning Letter 03-0758 was issued on March 25, 2003, for "installation of lighting at northernmost 7th Avenue South shopfront (Parsley Sage) without permit(s)"; Warning Letter 06-0246 was issued on November 21, 2005, for "removal of storefront, installation of ATM and neon sign without permit(s)"; and Warning Letter 06-0247 was issued on November 21, 2005, for "installation of conduit without permit(s)." With regard to this proposal, the Commission found that removing the non-historic metal and glass infill, neon signage, lighting, security roll-down gates, tracks and housing, and mechanical equipment from the ground floor will eliminate unsympathetic alterations that detract from the building; that the proposed storefront infill, featuring centralized wood and glass doors, and display windows above brick bulkheads, will recall similar commercial infill at other buildings of a similar age and style located elsewhere within this historic district; that the only signage, which will be limited to the flexible skirts of two awnings, that meet the Commission's rules for awning, will be located in direct proximity to the commercial tenants which they will serve and will not overwhelm the building; and that the work, will enhance the special architectural character of the building and the streetscape. Based on these findings, the Commission determined that the work is appropriate to the building and to the historic district, and voted to approve this application. However, in voting to grant this approval, the Landmarks Preservation Commission made its determination subject to the condition that the interior security gates, tracks and housing be more clearly expressed in the storefront section; and that the paneled wood sign band be further recessed to more closely align with the display window below, and that two sets of final signed and sealed drawings showing the approved proposal, which shall be filed with the Department of Buildings, be submitted to the Landmarks Preservation Commission for review and approval. Subsequently, on August 11, 2006, the Commission received two sets of a final stamped and signed drawing labeled PC1 through LPC6, dated August 1, 2006, prepared by Loren Eugene Cannon, R.A. The Landmark Preservation Commission staff reviewed the submitted drawings and found that the security gates and signage has been modified to reflect the Commissioners requests; and that the proposal approved by the Commision has been maintained. Based on this and the above findings, these drawings are being marked approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
