| Text | Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of July 18, 2006, following the Public Meeting and Public Hearing of July 11, 2006, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed on June 15, 2006. This permit will expire on July 18, 2012. The proposed work, as approved, consists of the creation of a front areaway, including the installation of an areaway fence (2 feet 7.5 inches high) with a black painted finish, installed into a bluestone curb (4 inches high), located adjacent to the public sidewalk. The work was shown on presentation boards consisting of drawings and photographs, dated July 2006, prepared by Christopher Warnick, R.A., and presented at the Public Hearing and Public Meeting. In reviewing this application, the staff noted that 123 Joralemon Street is a house designed by Joseph Stella and built in 1993. The Commission finally noted that Certificate of Appropriateness 93-0091 (LPC 93-2055) was issued March 29, 1993 for partially demolishing the building, adding two stories and redesigning the Joralemon Street facade. With regard to this proposal, the Commission found that the presence of an areaway fence is a feature common to the streetscape and the historic district; that the simple design and details of the proposed fence will be harmonious with the details of the facade and will be an unobtrusive addition to the building and streetscape; that the creation of the front areaway will not remove or obscure any of the building's significant architectural features; that the design of the fence, gates and front entry will relate to the historic ironwork still in place at the adjoining mansion; and that the installation of new bluestone paving and planting bed will be in keeping with the materials found in areaways of this historic district. Based on these findings, the Commission determined that the work is appropriate to the building and to the historic district, and voted to approve this application. However, in voting to grant this approval, the Commission made its determination subject to the stipulation that two sets of final signed and sealed drawings, showing the approved work, which are to be filed at the Department of Buildings, be submitted to the staff of the Commission for review and approval. Subsequently, on August 23, 2006, the staff of the Commission received drawings AL1.1 and AL1.2, dated July 25, 2006, prepared by Christopher Warnick, R.A. The Commission staff noted that the drawings included additional work including replacing the existing vinyl garage door with a wood multi panel garage door with a black painted finish; relocating an exterior light fixture; and installing an iron gate at the front entrance to match the iron wok at the areaway. With regard to the additional work, the Commission finds that the style and scale of the proposed light fixture, garage door, and door gate are harmonious with the scale of the building's façade; and that the size, placement, and materials will cause these items to blend into the surrounding areaway. The Commission reviewed the submitted drawings and found that proposal approved by the Commission has been maintained. Therefore, these drawings are being marked approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being issued. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
