Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of September 30, 2003, following the Public Hearing of September 23, 2003, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed August 28, 2003. The proposal, as approved, consists of constructing a one story rooftop addition and installing a fire escape on the rear north facade at the subject premises, as shown in photographs and drawings A100 - A107 and A-109 dated August 20, 2004 and north and south elevations prepared by Sergio Guardia, submitted as components of the application and presented at the Public Hearing and Public Meeting. In reviewing the proposal, the Commission noted that the Upper West Side-Central Park West Historic District Designation Report describes 101 West 70th Street as a neo-Grec style apartment building designed by Thom & Wilson and built in 1885-86; and that in terms of its style, scale, materials and details, the building contributes to the special architectural and historic character for which the Upper West Side-Central Park West Historic District was designated. With regard to this proposal, the Commission found that that construction of the proposed roof top addition and fire escape will not damage any significant architectural features of the building; that the proposed addition will be minimally visible in conjunction with the primary facades and will not diminish the special architectural character of the building; that the addition will be seen in the context of larger buildings and other roof top additions; that the location of the proposed fire escape on a secondary facade will not detract from the significant architectural features of the building or the adjacent twin building; and that the proposed work will not diminish the special architectural and historic character of the building or the Upper West Side/Central Park West Historic District. Based on these findings, the Commission determined the work to be appropriate to the building and to the Upper West Side-Central Park West Historic District and voted to approve it. However, in voting to grant the approval, the Commission made its determination subject to the condition that the north wall of the rooftop addition be constructed of brick; that the finish of the metal be revised in consultation of the staff to make it more neutral; and that two signed and sealed copies of the final Department of Buildings filing drawings for the approved work, be submitted to the staff of the Commission for review and approval. Subsequently, on October 25, 2004, the Landmarks Preservation Commission received final drawings G100, A100 - -103, A300, A301, A400 and M101 dated revised September 7, 2004 prepared by Sergio J. Guardia, R.A., and S-101, S-102, S-202, S-302, S-401 and S-402 dated revised July 15, 2004, S-201, S-201A, S-301, S-303 and S-403 dated revised September 22, 2004 prepared by Bryan Kessler, P.E. Accordingly, the staff of the Commission reviewed the drawings, and found that the north penthouse wall will be finished with brick to match the brick on the rear facade of the building; and that the proposal had been amended by including constructing a stair bulkhead at the roof of the penthouse; constructing a railing at the roof of the penthouse at the west and north facades; creating new window openings at the west facade of the penthouse; altering the window openings at the east and south facades of the penthouse; and installing new air conditioning equipment at the roof of the building south of the proposed penthouse. The staff of the Commission reviewed the revisions and finds that the proposed new stair bulkhead and rooftop railings will be mininally visible from a public thoroughfare; that the proposed new window openings, altered window openings and proposed new air conditioning equipment will not be visible from a public thoroughfare; that the revised work will not destroy or damage any significant architectural features of the building; that the material changes requested by the Commission have been incorporated into the proposal; and that the proposal approved by the Commission had been maintained. Based on this and the above findings, the drawings have been marked approved with a perforated seal, and Certificate of Appropriateness 05-3849 is being issued. This permit is contingent upon the staff's review and approval of final metal finish samples. This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process. All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to Cynthia Danza. Robert B.
